Why You Need An Attorney

If you were injured in a car accident, you probably thought that the soreness you felt was to be expected, and in a few days or maybe a few weeks, you'd be better. Unfortunately, some people just don't get better. And while you're spending time going to doctors and physical therapy, you soon discover that the insurance company for the other driver, and even your own insurance company, are against you. The insurance company representatives talk like they're interested in helping you, but they work for big companies whose single purpose is to maximize profits for their shareholders. The way they accomplish that goal is to pay you as little as they can get away with to settle your claim.

When it comes to placing a value on your claim, insurance companies like to treat everyone the same. They don't take into consideration how the injury has affected you and will continue to affect you for years to come. An experienced Delaware car accident attorney will learn as much about you as possible in order to show how you, as an individual instead of a statistic, are no longer the same person you were before the accident.

It's not unusual for an insurance company to send you to a doctor for what they say is an independent medical examination. There's nothing independent about it. They use the same doctors over and over, and they pay these doctors a great deal of money to say things like "there's no objective evidence of your injury." You need an attorney to challenge what the doctor is saying by pointing out that just because the doctor can't see the injury doesn't mean the injury doesn't exist. By analogy, think about the Hubble telescope that let's scientists see stars they never knew existed. The insurance company doctor who says there's no objective evidence of your injury would also claim that all those newly discovered stars didn't exist before the Hubble telescope was invented, and it was just a coincidence that those stars came into existence at the same exact time the Hubble telescope was turned on.

The doctor hired by the insurance company uses words to imply that you're not injured. Take, for example, a recent case where a client suffered a brain injury in a car accident, and the doctor, a forensic neuropsychiatrist, tried to show that my client didn't have a brain injury by writing in his report to the insurance company that she didn't strike her head, didn't lose consciousness, and had a normal MRI. When challenged by me, the doctor was forced to admit that a person can have a traumatic brain injury despite the fact that they didn't strike their head, didn't lose consciousness, and had a normal MRI.

The tactics of insurance companies were the subject of an18 month investigation by CNN. Check out Anderson Cooper's reports on how insurance companies are more interested in profits than they are in their policy holders, and how they use a policy of delay, deny and defend.
